The Strait of Malacca is of great strategic and economic importance to both the region and the world, it being the fastest connector between the Pacific and Indian oceans, winding through the Malay Peninsula and Sumatra. At its narrowest point, the Strait of Malacca is less than 1.9 miles wide, with approximately 70,000 ships passing through its waters each year.
Over recent years there have been increasing maritime security concerns in the Strait of Malacca, which the Malaysian government is committed to address together with the Indonesian and Singaporean governments, jointly establishing operational commands, increased patrols and monitoring stations to in order to enhance the safety of vessels passing through its (territorial) waters.
Since the Strait of Malacca is not if wholly made up out of territorial waters, (article 17 – 18 and 19 of UNCLOS right of Innocent passage) there are legal issues with having Private Maritime Security Companies operate within its waters. The current absence of a clear legal framework and lack of enforcement of said laws has led to international PMSCs operating within Malaysia’s territorial waters illegally and without an official license to do so.
The current conundrum can now be successfully and legally addressed through the deployment of maritime auxiliary police as boarding officers/sea marshals, which only Noah Maritime Services can provide via the Malaysian government’s approval for the embarkation and disembarkation of boarding officers.
